I have read and understand the following: Under Section 6094.5 of the Revenue and Taxation Code, an individual may be accused of a misdemeanor if they are aware at the point of purchase that they will use the bought item before reselling it (excluding retention, demonstration, or display while waiting for resale), and they provide a resale certificate to evade tax payment to the seller. Furthermore, if a person misuses a resale certificate for personal profit or to dodge tax payment, they will be liable, for every purchase, to pay the amount of tax that should have been paid, along with a penalty of either 10 percent of the tax amount or $500, whichever amount is higher.
